LIMITED WARRANTY AGREEMENT – Acrylic Hybrid Prosthesis
Aesthetic Dental Care – Prosthesis and Implant Warranty (Acrylic Hybrid Prosthesis)
This Agreement sets forth the terms and conditions of the contractual warranty offered by Aesthetic Dental Care Costa Rica with respect to acrylic hybrid prostheses used in full-arch implant rehabilitations.
01
Purpose and Covered Treatment
This contractual warranty applies exclusively to acrylic hybrid prostheses used in full-arch implant rehabilitations, including All-on-4, All-on-5, and All-on-6 treatments, provided that the prosthesis was planned, fabricated, installed, and delivered by Aesthetic Dental Care Costa Rica.
This warranty specifically covers the acrylic hybrid prosthesis and the services directly related to its fabrication, installation, adjustment, repair, or replacement performed by Aesthetic Dental Care Costa Rica.
Dental implants, abutments, attachments, prosthetic components, metal frameworks, or other treatment elements are not covered by this warranty unless expressly included in a specific warranty document.
This contractual warranty is granted without prejudice to the rights and warranties available to the patient under applicable Costa Rican law and does not constitute an advance waiver of such rights.
02
Warranty Period
This contractual warranty shall remain in effect for three (3) years from the date of final delivery of the prosthesis, as documented in the patient’s clinical record. For purposes of this warranty, the final delivery date shall mean the date on which the definitive prosthesis was installed and delivered to the patient, after the corresponding clinical adjustments were completed and such delivery was documented in the clinical record.
A repair, adjustment, or replacement performed under this warranty shall not begin a new three (3)-year period, unless otherwise required by applicable law.
The expiration of this contractual warranty period shall not affect any rights or responsibilities that, by law, cannot validly be excluded or limited by agreement between the parties.
03
Covered Failures
During the warranty period, this warranty may cover the repair or replacement of the acrylic hybrid prosthesis when, following clinical and technical evaluation, the failure is determined to result from a manufacturing defect, technical defect, or clinical error directly attributable to Aesthetic Dental Care Costa Rica.
The following may be covered, as applicable:
- 1) Fractures of the prosthesis attributable to manufacturing or workmanship defects.
- 2) Detachment or failure of prosthetic components attributable to a technical or manufacturing defect.
- 3) Structural failures of the prosthesis directly attributable to its fabrication, design, or installation by Aesthetic Dental Care Costa Rica.
- 4) Other failures that, following clinical and technical evaluation, are determined to be the direct result of a manufacturing defect or clinical or technical action attributable to the clinic.
When a failure is determined to be covered by this warranty, Aesthetic Dental Care Costa Rica will, as appropriate and according to clinical and technical criteria, repair or replace all or part of the prosthesis without charge for the materials and clinical services directly necessary to correct the covered failure.
04
Evaluation and Determination of Coverage
Any request for application of this warranty shall be subject to a clinical and, when appropriate, technical evaluation. The patient must report the failure as soon as reasonably possible and allow Aesthetic Dental Care Costa Rica to examine the prosthesis and perform the evaluations necessary to determine its cause. In determining whether a failure is covered, the following may be considered, among other factors:
- 1) the clinical record;
- 2) the patient’s clinical evaluation;
- 3) inspection of the prosthesis;
- 4) the circumstances in which the failure occurred;
- 5) use and maintenance of the prosthesis;
- 6) compliance with the instructions provided to the patient; and
- 7) any other reasonably relevant clinical or technical factor.
The existence of a circumstance listed as an exclusion in this agreement shall not automatically result in denial of the warranty. Where applicable, there must be a reasonable causal relationship between that circumstance and the claimed failure.
05
Implants, Components, and Treatments Performed by Third Parties
This warranty applies exclusively to the acrylic hybrid prosthesis and the services provided by Aesthetic Dental Care Costa Rica.
When an implant, component, attachment, prosthesis, or any other treatment-related element has been placed, modified, repaired, adjusted, or otherwise treated by another professional or provider, failures that, after evaluation, are directly and causally attributable to that external intervention may fall outside the scope of this warranty.
Third-party intervention alone shall not automatically void the entire warranty. The exclusion shall apply only to failures that have a causal relationship with such intervention.
06
Location Where Warranty Services Are Provided
Evaluations, repairs, adjustments, or replacements covered under this warranty shall be performed at the facilities of Aesthetic Dental Care Costa Rica in Costa Rica, unless the clinic determines another service arrangement in writing.
Transportation, airfare, lodging, meals, and other personal expenses incurred by the patient in traveling to Costa Rica are not included in this contractual warranty, unless Aesthetic Dental Care Costa Rica expressly agrees otherwise in writing or applicable law requires different treatment.
This provision relates exclusively to travel and lodging expenses and does not constitute a release of liability with respect to obligations legally applicable to the clinic.
07
Warranty Exclusions
This contractual warranty shall not cover failures that, following clinical and technical evaluation, are directly attributable to circumstances unrelated to a manufacturing defect, technical defect, or clinical error attributable to Aesthetic Dental Care Costa Rica:
- 1. Accidents, trauma, or improper use: Damage caused by accidents, trauma, impacts, falls, sports injuries, or other external events is not covered. Damage resulting from use of the prosthesis inconsistent with the instructions provided by the clinic may also be excluded, including using it for purposes other than its normal function or biting objects that may cause overload or damage, when there is a causal relationship between such conduct and the claimed failure.
- 2. Normal wear: Normal wear resulting from use and the passage of time does not, by itself, constitute a failure covered by this warranty. This includes changes inherent to the use of acrylic materials that do not represent a manufacturing defect or structural failure attributable to the clinic.
- 3. Bruxism and functional overload: Damage associated with bruxism, clenching, or functional overload may be excluded when the clinic has identified the condition, recommended protective measures—including, when appropriate, the use of a night guard—and it is determined that failure to follow that recommendation directly contributed to the claimed failure. The existence of bruxism shall not automatically void the warranty.
- 4. Medical conditions: A medical condition existing before or developing after treatment shall not automatically void the warranty. However, when clinical evaluation determines that a medical or systemic condition of the patient was a direct and relevant cause of the claimed failure, that failure may fall outside the scope of this contractual warranty. The patient must provide the treating professional with complete and truthful information regarding medical history, medications, and health conditions relevant to treatment.
- 5. Third-party interventions: Failures directly caused by modifications, repairs, adjustments, surgical procedures, or prosthetic interventions performed by third parties shall fall outside the scope of this warranty when there is a causal relationship between such intervention and the claimed failure.
- 6. Failure to follow care instructions: Failures that are a direct consequence of failure to follow specific care, hygiene, maintenance, or use instructions provided by Aesthetic Dental Care Costa Rica may be excluded, provided that such noncompliance causally contributed to the claimed failure.
08
Follow-up Visits and Maintenance
The patient must follow the clinical and maintenance instructions provided by Aesthetic Dental Care Costa Rica, including recommendations regarding oral hygiene, periodic checkups, and prosthesis maintenance. Dental and hygiene checkups are recommended at least every six (6) months, or at the frequency determined by the treating professional based on the patient’s particular clinical conditions.
Failure to attend a follow-up visit shall not, by itself, automatically void the warranty. However, when the absence of follow-up visits, failure to follow maintenance instructions, or failure to obtain timely care for a complication directly contributed to the claimed failure, that circumstance may be considered in determining whether the failure is covered.
09
Post-Surgical Follow-up and Provisional Prosthesis
When the treatment plan includes a follow-up visit approximately four (4) months after the initial surgery, the purpose of that appointment shall be to evaluate clinical progress, the healing process, tissue condition, and the function of the provisional prosthesis, when applicable.
The patient’s unjustified failure to attend this appointment may be considered in the evaluation of a subsequent claim when there is a causal relationship between the lack of follow-up and the claimed failure. Failure to attend this appointment shall not automatically result in total loss of the warranty.
10
Aesthetic Modifications Requested by the Patient
Once the prosthesis has been finally delivered and approved by the patient, any subsequent modification requested solely for aesthetic reasons or personal preference, including changes in shape, size, design, arrangement, or color that are not intended to correct a covered defect or failure, shall not be included under this warranty.
Work requested for these reasons may result in additional charges, which must be disclosed to and accepted by the patient in advance. This exclusion shall not apply when the modification is necessary to correct a failure covered by this warranty.
11
Repair or Replacement Under Warranty
When a failure is determined to be covered, Aesthetic Dental Care Costa Rica may, according to clinical and technical criteria:
- 1) repair the prosthesis;
- 2) replace all or part of the affected components; or
- 3) replace the prosthesis when repair is not clinically or technically appropriate.
The applicable solution shall be determined according to the nature, extent, and cause of the failure, with the goal of providing an appropriate solution based on the patient’s clinical circumstances.
When the failure is covered, the materials and clinical services directly necessary for the repair or replacement shall be covered by Aesthetic Dental Care Costa Rica.
12
SEDATION AND ANESTHESIA
When anesthesia or sedation is clinically necessary for a repair or corrective procedure, the clinic shall inform the patient in advance of the need for it and of the corresponding financial terms.
When the procedure is directly necessary to correct a covered failure, Aesthetic Dental Care Costa Rica shall determine in advance and in writing which costs are included in the coverage and which, if any, must be borne by the patient, in accordance with applicable law and the conditions previously disclosed.
No provision of this document shall be interpreted as authorization to transfer to the patient costs that legally correspond to the clinic, or vice versa.
13
Procedure for Requesting Warranty Service
To request application of this warranty, the patient must contact Aesthetic Dental Care Costa Rica through the clinic’s official communication channels and provide, to the extent reasonably possible:
- 1) full name;
- 2) approximate treatment date;
- 3) description of the failure;
- 4) date the failure was identified; and
- 5) any additional information reasonably necessary to perform the evaluation.
The clinic will coordinate an evaluation and determine, based on clinical and technical criteria, whether the failure falls within the scope of the warranty.
When the patient is outside Costa Rica, the failure may initially be reported through the clinic’s official contact channels. When an in-person evaluation is necessary, the corresponding appointment will be coordinated in Costa Rica.
The patient must allow the clinic to evaluate the prosthesis before it is repaired, modified, or otherwise treated by a third party, whenever reasonably possible.
14
Patient Responsibilities
The patient agrees to:
- 1) provide complete and truthful medical information relevant to treatment;
- 2) follow the hygiene, care, and maintenance instructions provided by the professional;
- 3) attend recommended follow-up visits;
- 4) use any protective devices that have been clinically indicated;
- 5) promptly report any pain, mobility, fracture, detachment, or other alteration related to the prosthesis; and
- 6) allow the clinical and technical evaluation necessary to determine the cause of a claimed failure.
Failure to comply with any of these obligations shall not automatically result in total loss of the warranty, but shall be considered only to the extent that it has a causal relationship with the claimed failure.
15
Patient Rights and Applicable Law
This document establishes a specific and additional contractual warranty with respect to the acrylic hybrid prosthesis and does not constitute a waiver, limitation, or exclusion of any rights available to the patient under applicable Costa Rican law. In particular, no provision of this agreement shall be interpreted as a release from liability for breach, defective performance, professional negligence, harm to health, or other liabilities that legally cannot be excluded or limited.
The provisions of this agreement shall be interpreted in accordance with applicable Costa Rican law, including consumer protection rules and provisions governing the rights of users of health services.
If any provision of this agreement is incompatible with an applicable mandatory rule of law, that legal provision shall prevail, while the remaining clauses shall remain in effect to the fullest extent legally possible.
16
Information, Consent, and Acceptance
The patient states that they have received clear and sufficient information regarding the scope of this warranty, its term, conditions, exclusions, responsibilities, and the procedure for requesting its application. The patient further states that they had the opportunity to ask questions and request any clarifications considered necessary before signing this document.
The signature of this document confirms receipt and understanding of its terms and conditions and does not constitute an advance waiver of rights recognized under Costa Rican law.
LIMITED WARRANTY AGREEMENT – ZIRCONIA PROSTHESIS
Aesthetic Dental Care Costa Rica – Prosthesis and Implant Warranty (Zirconia Prosthesis)
01
COVERED TREATMENT
This warranty applies to full-arch rehabilitations of the All-on-4, All-on-5, and All-on-6 type performed exclusively by Aesthetic Dental Care Costa Rica, including zirconia prostheses and implants placed by the clinic as part of the treatment.
The warranty covers only the elements and services expressly indicated in this document and is subject to the conditions, limitations, and exclusions set forth herein.
02
WARRANTY PERIOD
This contractual warranty shall remain in effect for four (4) years from the date of final delivery of the prosthesis, as documented in the patient’s clinical record. For purposes of this warranty, the final delivery date shall mean the date on which the definitive prosthesis was installed and delivered to the patient, after the corresponding clinical adjustments were completed and such delivery was documented.
A repair, adjustment, or replacement performed under this warranty shall not start a new four (4)-year period, unless an applicable legal provision expressly establishes otherwise.
The end of the four (4)-year period shall terminate this specific contractual warranty, without prejudice to any rights or responsibilities that, under mandatory law, may not be validly excluded or limited.
03
SCOPE OF THE WARRANTY
Covered Failures: During the warranty period, Aesthetic Dental Care Costa Rica will cover the repair or replacement of the zirconia prosthesis and, when applicable, the affected implant, when a prior clinical and technical evaluation determines that the failure is directly attributable to a manufacturing defect, technical defect, or clinical action attributable to the clinic.
The following may be covered, as applicable:
- 1) Fractures, chips, or breakage of the zirconia prosthesis attributable to manufacturing or workmanship defects.
- 2) Structural failures of the prosthesis attributable to manufacturing, design, or installation defects.
- 3) Failures of prosthetic components attributable to technical or manufacturing defects.
- 4) Failures of implants placed by Aesthetic Dental Care Costa Rica when, after clinical evaluation, the failure is determined to be directly attributable to an implant defect, its placement, or a clinical or technical action attributable to the clinic.
When a failure is determined to be covered, Aesthetic Dental Care Costa Rica will, as appropriate and according to clinical and technical criteria, repair or replace the affected element at no charge for the materials and clinical services directly necessary to correct the covered failure.
Coverage does not constitute an absolute guarantee of the biological outcome of treatment, particularly with respect to healing, osseointegration, and the individual response of the body.
04
IMPLANTS PLACED BY AESTHETIC DENTAL CARE
The implant warranty applies exclusively to implants placed by Aesthetic Dental Care Costa Rica as part of the treatment covered by this agreement. Implants, components, or treatments performed, placed, modified, or otherwise treated by third parties will not be covered when the claimed failure is directly or causally attributable to such third-party intervention.
Third-party intervention shall not automatically result in the loss of the entire warranty, but only in the exclusion of failures that have a causal relationship with the intervention, modification, repair, or treatment performed by that third party.
05
PLACE OF COVERAGE
Treatments, evaluations, repairs, and corrective procedures covered under this warranty will be performed at Aesthetic Dental Care Costa Rica facilities in Costa Rica, unless the clinic determines another method of care in writing.
The patient shall be responsible for expenses related to travel to Costa Rica, including airfare, lodging, meals, and other personal expenses. These expenses are not part of this contractual warranty and will not be reimbursed by Aesthetic Dental Care Costa Rica, unless the clinic expressly agrees otherwise in writing or applicable law provides otherwise.
This provision refers exclusively to travel, transportation, and lodging expenses and does not constitute a release from liability for obligations legally attributable to the clinic.
06
WARRANTY EXCLUSIONS
This warranty will not cover failures that, after clinical and technical evaluation, are attributable to circumstances unrelated to a manufacturing defect, technical defect, or clinical action attributable to Aesthetic Dental Care Costa Rica:
- 1. Accidental damage, trauma, and improper use: The warranty will not cover fractures, chips, breakage, or damage caused by accidents, trauma, impacts, falls, sports injuries, or other external events. Damage resulting from improper use of the prosthesis is also not covered, including, among other things, biting excessively hard objects, using the prosthesis for purposes other than its normal function, or subjecting it to forces incompatible with its intended use, when there is a causal relationship between such conduct and the failure.
- 2. Medical conditions and biological factors: This warranty does not constitute a guarantee of the patient’s individual biological response. Implant or prosthesis failures will not be covered when, after clinical evaluation, they are determined to be directly or primarily attributable to a medical, systemic, metabolic, immunological, or biological condition of the patient, whether pre-existing or developed after treatment.
Such conditions may include, depending on the particular circumstances of the case: uncontrolled diabetes; osteoporosis or other bone metabolism disorders; immunological disorders; systemic diseases affecting healing; metabolic disorders; diseases or treatments that compromise osseointegration; medications that may significantly affect healing or implant integration; and any other condition that, according to clinical evaluation, may materially affect the stability or biological outcome of treatment.
When any of these conditions is the direct cause or a determining factor in the failure, the corresponding failure will not be covered by this warranty, even if it occurs during the four (4)-year period. The existence of a medical condition will not automatically exclude other independent failures that have no causal relationship with that condition.
The patient must provide complete, accurate, and truthful information regarding medical history, diagnosed diseases, medications, treatments, and other conditions relevant to the procedure. The omission, concealment, or incomplete disclosure of relevant medical information may be considered when determining the cause of a failure, particularly when such information would have been necessary to assess risks, adopt preventive measures, or determine treatment suitability.
- 3. Failure to follow medical recommendations: Failures that are the direct result of the patient’s failure to follow specific clinical instructions provided by Aesthetic Dental Care Costa Rica will not be covered when such noncompliance causally contributed to the failure. This includes, among other things, failure to follow instructions regarding oral hygiene; diet during the period indicated by the professional; use and care of the prosthesis; clinical follow-up visits; prescribed medications; recommended protective devices; and any other clinical instruction related to the maintenance and protection of the treatment.
- 4. Bruxism and functional overload: Damage resulting from bruxism, clenching, or functional overload may be excluded when the clinic has identified or warned of the condition, recommended protective measures, and it is determined that failure to use those measures directly contributed to the failure. When use of a night guard has been recommended, failure to use it may be considered in determining warranty eligibility. Bruxism alone shall not automatically result in the loss of the entire warranty.
- 5. Normal wear: Normal wear resulting from use and the passage of time is not covered. This includes superficial wear inherent to zirconia materials and other changes consistent with normal use that do not constitute a manufacturing defect or structural failure attributable to the clinic.
- 6. Third-party interventions: Failures caused directly or causally by repairs, modifications, adjustments, surgical interventions, prosthetic treatments, or any other intervention performed by third parties are not covered. The patient must allow Aesthetic Dental Care to evaluate the failure before the prosthesis or implants are modified or treated by third parties, whenever reasonably possible.
- 7. Biological complications: Biological complications that are not attributable to an implant defect, clinically incorrect placement, or another clinical or technical action attributable to Aesthetic Dental Care Costa Rica are not covered. Osseointegration, healing, and biological response may vary among patients and depend on individual factors that cannot be fully controlled by the clinic. Accordingly, this warranty does not constitute an absolute guarantee of osseointegration, absence of biological complications, or implant retention throughout the entire four (4)-year period.
07
SURGICAL REINTERVENTIONS, ANESTHESIA, AND SEDATION
When a covered failure requires surgical reintervention, Aesthetic Dental Care Costa Rica will cover the clinical procedures and materials directly necessary to correct the covered failure, according to the corresponding clinical evaluation.
When sedation or anesthesia is necessary to perform the procedure, the clinic will inform the patient in advance of the need for it and the corresponding costs.
When, under the terms of the warranty, such cost is the patient’s responsibility, the patient must assume that cost.
Nothing in this agreement shall be interpreted as authorization to transfer to the patient costs that legally correspond to the clinic, or vice versa.
08
FOLLOW-UP AND MAINTENANCE
The patient must attend the clinical follow-up and hygiene visits recommended by Aesthetic Dental Care Costa Rica. At a minimum, follow-up and hygiene visits are recommended every six (6) months, unless the treating professional determines a different frequency based on the patient’s particular conditions.
The patient must follow the oral hygiene, maintenance, and prosthesis care instructions provided by the clinic. Missing a follow-up visit will not automatically result in total loss of the warranty. However, when lack of follow-up, maintenance, or timely attention to a complication is determined to have directly contributed to the claimed failure, that circumstance may exclude coverage of the corresponding failure.
09
POST-SURGICAL FOLLOW-UP AND PROVISIONAL PROSTHESIS
When the treatment plan includes a second visit approximately in the fourth (4th) month after the initial surgery, the patient must attend that appointment to allow evaluation of the healing process, clinical progress, and function of the provisional prosthesis, when applicable. An unjustified absence may be considered in evaluating a subsequent claim when there is a causal relationship between the lack of follow-up and the claimed failure. Failure to attend will not automatically result in total loss of the warranty.
10
AESTHETIC MODIFICATIONS REQUESTED BY THE PATIENT
Any change in the shape, size, design, arrangement, or color of the prosthesis requested by the patient after final delivery and approval of the prosthesis, when based solely on an aesthetic preference and not on a covered defect or failure, is not included under this warranty.
Such modifications will be considered elective aesthetic requests and may result in additional costs to the patient, which must be disclosed and accepted in advance. This exclusion does not apply when the modification is necessary to correct a failure covered by this warranty.
11
PROCEDURE FOR REQUESTING WARRANTY SERVICE
To request application of the warranty, the patient must contact Aesthetic Dental Care Costa Rica through the clinic’s official communication channels and provide, to the extent reasonably possible:
- 1. full name;
- 2. approximate date of treatment;
- 3. description of the failure;
- 4. date the failure was identified; and
- 5. any additional information reasonably necessary to perform the evaluation.
The clinic will coordinate a clinical evaluation and, when applicable, a technical evaluation to determine the cause of the failure and whether it is covered.
When the patient is outside Costa Rica, the failure may initially be reported through the clinic’s official contact channels. When an in-person evaluation is necessary, it will be coordinated in Costa Rica.
The patient must allow Aesthetic Dental Care to evaluate the prosthesis or implants before they are repaired, modified, or treated by third parties, whenever reasonably possible.
12
REPAIR OR REPLACEMENT UNDER WARRANTY
When a failure is determined to be covered, Aesthetic Dental Care Costa Rica may, according to clinical and technical criteria:
- 1) repair the prosthesis;
- 2) repair or replace the affected component;
- 3) replace the prosthesis in whole or in part; or
- 4) replace the affected implant when applicable and when the failure is covered.
The applicable solution will be determined according to the nature, extent, and cause of the failure. When the failure is covered, the materials and clinical services directly necessary for repair or replacement will be covered by Aesthetic Dental Care Costa Rica.
13
PATIENT RESPONSIBILITIES
The patient must:
- 1) provide complete, accurate, and truthful medical information;
- 2) report any relevant change in health status;
- 3) follow the clinical instructions provided;
- 4) attend recommended follow-up and maintenance visits;
- 5) maintain adequate oral hygiene;
- 6) use recommended protective devices;
- 7) promptly report any mobility, fracture, detachment, pain, or alteration related to the prosthesis or implants;
- 8) allow the clinical and technical evaluation necessary to determine the cause of any failure; and
- 9) avoid third-party interventions before the clinic can evaluate the failure, whenever reasonably possible.
Failure to comply with these responsibilities may exclude from the warranty those failures that are a direct consequence of such noncompliance.
14
TRAVEL AND LODGING EXPENSES
The patient acknowledges that this warranty is performed in Costa Rica. Accordingly, unless otherwise agreed in writing or required by applicable law, the patient is responsible for transportation expenses; airfare; lodging; meals; local transportation; companions; and other personal expenses related to travel to and stay in Costa Rica. These expenses are not part of the warranty price or the covered clinical services.
15
PATIENT RIGHTS AND APPLICABLE LAW
This contractual warranty establishes specific four (4)-year coverage for the treatments included in this document. The warranty shall be interpreted in accordance with applicable Costa Rican law and does not constitute an advance waiver of rights recognized by mandatory legal provisions.
Nothing in this agreement shall be interpreted as a release from liability for conduct, obligations, or responsibilities that legally may not be excluded or limited.
If any provision of this agreement is incompatible with an applicable mandatory legal rule, that legal provision shall prevail, while the remaining clauses shall remain in force to the fullest extent legally possible.
16
ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS
The patient states that he or she has received clear and sufficient information regarding:
- 1) the scope of the warranty;
- 2) its four (4)-year term;
- 3) covered failures;
- 4) exclusions;
- 5) patient responsibilities;
- 6) the procedure for requesting warranty service; and
- 7) conditions related to travel and lodging expenses.
The patient further states that he or she has had the opportunity to ask questions and request any clarifications considered necessary before signing this document.
The signature on this document confirms receipt and acknowledgment of its terms and conditions and does not constitute an advance waiver of rights recognized under Costa Rican law.
LIMITED WARRANTY AGREEMENT
Aesthetic Dental Care - Prosthetic Warranty (Crowns and Veneers)
01
Treatment Covered
Crowns and veneers placed exclusively at Aesthetic Dental Care Costa Rica.
02
Warranty Period
This warranty shall remain valid for three (3) years from the final delivery date of the crowns or veneers.
03
Scope of the Warranty
- 1. Covered Failures: This warranty covers fractures, breakage, or debonding (detachment) of crowns or veneers occurring within the warranty period when, following a clinical evaluation, the failure is determined to be directly attributable to a manufacturing defect, technical defect, or clinical action attributable to Aesthetic Dental Care Costa Rica.
When a failure is determined to be covered, Aesthetic Dental Care will repair or replace the affected crown or veneer, as appropriate, at no cost for the materials and clinical services directly necessary to correct the covered failure.
- 2. Place of Coverage: Treatments and corrections under warranty will be performed exclusively at our clinic in Costa Rica. The patient will be responsible for all travel-related expenses, including airfare, lodging, and other personal expenses. Aesthetic Dental Care does not cover or reimburse travel costs unless otherwise agreed to in writing or required by applicable law.
04
Warranty Exclusions
- 1. Patient-Requested Aesthetic Modifications: Once the patient has approved the final design, shape, size, and color, any request for changes after delivery that is based exclusively on the patient’s aesthetic preference will not be covered by this warranty. Such modifications will be considered elective aesthetic requests and will result in additional costs to the patient.
- 2. Accidental Damage: The warranty does not cover fractures, breakage, or damage caused by accidents, trauma, or misuse, including, but not limited to, sports injuries, impacts, or biting excessively hard objects, when there is a causal relationship between such events and the failure.
- 3. Failures of Root Canal Treatments Performed at Other Clinics: If a root canal treatment performed by another clinic or professional fails and such failure requires the removal, repair, or replacement of a crown placed by Aesthetic Dental Care, the costs resulting from that failure will not be covered by this warranty.
Having a root canal treatment performed by a third party will not automatically void the warranty with respect to other failures that are not causally related to that treatment.
- 4. Medical or Biological Factors: Failures resulting directly or primarily from medical or biological conditions, or changes in the patient’s health that affect the teeth, bone support, or stability of the restoration, will not be covered by this warranty. This may include, among other conditions, systemic diseases, periodontal disease, changes in dental or bone support, and other conditions that, according to the clinical evaluation, directly contribute to the failure.
The existence of a medical condition will not automatically result in the total loss of warranty coverage when that condition is not causally related to the claimed failure.
- 5. Bruxism and Functional Overload: Damage resulting from bruxism, teeth clenching, or functional overload will not be covered when these are the cause of the fracture, breakage, or debonding. When the clinic has recommended the use of a night guard or other protective device, failure to use such protection may be considered when determining whether warranty coverage applies.
- 6. Third-Party Interventions: Failures caused by repairs, modifications, adjustments, or treatments performed by third parties on the crown, veneer, supporting tooth, or related structures will not be covered.
05
Patient Noncompliance
The patient must comply with the maintenance protocols recommended by the clinic, including dental checkups and hygiene visits at least every six (6) months, unless the treating professional recommends a different frequency.
Failure to attend follow-up visits will not automatically result in the total loss of warranty coverage; however, when it is determined that lack of follow-up, maintenance, or timely care directly contributed to the claimed failure, that failure may be excluded from warranty coverage.
06
Patient Responsibilities
- 1) Attend routine dental checkups and hygiene visits at the recommended intervals.
- 2) Follow the oral hygiene, care, and maintenance instructions provided by the clinic.
- 3) Use recommended protective devices, when applicable.
- 4) Promptly report any pain, mobility, fracture, or detachment.
- 5) Provide complete and truthful relevant medical and dental information.
- 6) Cover all travel, lodging, and personal expenses related to warranty visits.
07
Final Statement
This warranty provides the patient with assurance regarding the quality of care and establishes that clinical or technical failures directly attributable to Aesthetic Dental Care Costa Rica that result in fracture, breakage, or debonding of crowns or veneers during the three (3) year warranty period will be corrected at no cost for the materials and clinical services directly necessary to resolve the covered failure.
This warranty does not cover failures attributable to accidents, misuse, medical or biological conditions, root canal treatments performed by third parties, bruxism or functional overload, third-party interventions, normal wear, or patient-requested aesthetic modifications, in accordance with the terms established in this document.
This warranty does not constitute an advance waiver of rights recognized under Costa Rican law, nor an exemption from liabilities that legally cannot be excluded or limited.
I declare that I have read, understood, and accepted the information contained in this document.
